The Water Scrooge™ One-Year Limited Warranty

 

  • Product Warranty

The Water Scrooge™ (“TWS”) will pass through the original manufacturer’s warranty for The Water Scrooge products (the “Products”) as specified below. The Warranties only apply to the Products and labor provided by TWS when installing/purchasing the Products. 

 

Limited Manufacturer’s Warranty

Limited Manufacturer Warranty.

The Products comes with a Manufacturer’s warranty for one (1) year following the delivery of the products if purchased online and for one (1) year following the installation of the products if the products were installed by TWS (the “Warranty Period").  During the Warranty Period, the Products shall be free from defects in materials and workmanship. The manufacturer’s sole obligation under this warranty shall be to provide, at no charge, replacement Product(s). A defective Product must be returned to TWS for warranty replacement (unless TWS determines such return is unnecessary), and the returned Product shall become TWS’s property. For a warranty claim to be made, the customer must follow the procedures established by TWS. The Manufacturer’s warranty is a complete replacement warranty for a Product that is found to be defective, including leaking at the point of installation or where the product does not operate as intended, which includes but is not limited to limiting, restricting, or otherwise preventing water from flowing through the product to the water fixture. Where defective products are returned to TWS, TWS will be responsible for all shipping costs, including freight, customs, duties, and insurance for the replacement product.

  • TWS Labor Warranty

If TWS installing the products, TWS warrants installing the Products against defects in workmanship for one (1) year following the conclusion of on-site installation. If the Purchaser discovers an installation defect within the Labor Warranty period, the Purchaser must immediately notify TWS in writing describing the nature of the defect. If the defect is due to negligence on the part of TWS during installation, TWS will correct the defect at no additional charge to the purchaser. The purchaser shall bear the costs of all repairs and replacements not expressly covered by the Labor Warranty.

 

What Is Not Covered:

Any damage, defect, or malfunction caused by abuse, misuse, neglect, vandalism, accident, act of God (e.g., flood, fire, lightning), a surge or disruption in water pressure (however caused), a water leak or damage resulting from limescale removal, excessive operating conditions, normal wear and tear, or other cause beyond the reasonable control of TWS is not covered by the warranties. Also, any damage, defect or malfunction resulting from one or more of the following is not covered by the warranties: faulty or improper repair or installation of the Products not performed by TWS; improper or deficient plumbing or water supply; use of a non-potable, highly-corrosive or hot/tempered water supply; unauthorized alteration or modification of the Product; use of accessories, components, parts or attachments not manufactured by the manufacturer of a Product or installed by TWS; failure of any fixture, device, part, accessory or product not sold or manufactured by the manufacturer of the Product or installed by TWS; 

 

Please be aware that water leaks from plumbing systems may result from a limescale removal process or water mains being turned on after a water shutdown process. Purchasers are therefore advised and have a duty to periodically inspect their plumbing systems to ensure that compression joints remain watertight. Claims made under the warranties are invalid unless an adequate water pressure surge protection device is used to protect the Products and its components. The warranties will not continue to provide coverage if the Product is removed and reinstalled on a different fixture.

 

How To Make A Claim & Get Service:

A claim under this warranty must be submitted by email to TWS at info@thewaterscrooge.com within 30 days of the discovery of the defect. The email to TWS must include (i) a copy of the dated sales receipt or proof of purchase of the Product, (ii) proof, sufficient to TWS, that the Product was installed properly, (iii) a written explanation of the issue(s) with the Product, (iv) one or more pictures of the Product before the Product was not operating as warranted, and (v) one or more pictures of the Product and surrounding area that displays such issue(s)

A TWS representative will then review the purchaser’s claim and contact them within ten business days to coordinate the product's repair or replacement or request additional information.

 

Purchaser Responsibilities

Purchasers are responsible for ensuring that the Product is maintained under TWS’s owner manual, technical materials, and other written instructions or recommendations attached to or furnished with the Product or posted on TWS’s website. Purchasers must not remove the product's serial number or label(s). Without limiting the other terms and conditions of the warranties and any other defenses that TWS may have, purchasers understand and agree that their failure to comply with the foregoing requirements will relieve TWS from any further responsibility to them under the warranties. Any product returns, including returns for reasons other than warranty claims (e.g., wrong product ordered/delivered), should be handled in accordance with TWS’s returns policy.

 

Limitation of Liability

THE WARRANTIES SET FORTH THE ENTIRE AGREEMENT BY TWS REGARDING ITS LIABILITIES CONCERNING THE PRODUCT AND LABOR. EXCEPT AS STATED ABOVE IN THE WARRANTIES AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS CONCERNING THE PRODUCT AND LABOR. CONCERNING IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, THEN TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWS LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES TO THE DURATION OF THE WARRANTIES (1 YEAR). IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TWS BE LIABLE TO THE PURCHASER OR ANY THIRD PARTY FOR ANY LOSS, COST, EXPENSE, DAMAGE, OR LIABILITY, WHETHER DIRECT OR INDIRECT, OR FOR CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES OF ANY KIND, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON BREACH OF CONTRACT, TORT, STRICT LIABILITY, BREACH OF WARRANTIES, OR OTHERWISE, AND EVEN IF ADVISED OF THE LIKELIHOOD OF SUCH DAMAGES. CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES INCLUDE BUT ARE NOT LIMITED TO ANY DAMAGES FOR LOST SALES OR LOST PROFITS ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT. 

 

THE FOREGOING WARRANTY IS THE SOLE AND EXCLUSIVE REMEDY AVAILABLE TO THE PURCHASER AND IS IN PLACE OF ALL OTHER WARRANTIES, GUARANTEES, OR REMEDIES, WHETHER WRITTEN OR ORAL, EXPRESSED OR IMPLIED, ALL OF WHICH TWS HEREBY EXPRESSLY DISCLAIMS. TWS’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE WARRANTIES OR THE PRODUCT WILL NOT EXCEED THE AMOUNT PAID BY THE PURCHASER FOR THE PRODUCT.
